The Fall Season

I have to admit that Fall is my favorite time of the year. The weather is usually great for outdoor activities. Not too hot and not too cool. You can wear jeans and a sweat shirt and be comfortable. There are always a ton of things to do like fall festivals, haunted houses, hay rides, and pumpkin patches. Not to mention carving pumpkins, dressing up and going trick or treating on Halloween night.           Many who are this path don't realize there are a couple of alternatives to foreclosure such as a Short Sale or Loss Mitigation. The Fauscett Team has been dealing with foreclosed houses for over 15 years. We felt it was time to try to help people before they get into this situation. We just recently have taken training classes in both Short Sales and Loss Mitigation
          You are probably wondering what is a Short Sale or Loss Mitigation. A Short Sale is a special transaction that allows you to sell your home even when your mortgage debt is higher than the value of your home. Loss Mitigation is where we negotiate with your lender to help you stop foreclosure and retain your home. The difference between the two options is being able to keep your home or getting out from under this burden while minimizing the damage to your credit.
          There are a large number of foreclosures right now and the lenders are losing a lot of money with each. They really don't want you to go into foreclosure any more than you do. The customer service reps. with the lending companies are limited in their services and are only responsible for collecting your past due amounts. We step in to either help negotiate reinstatement, loan modification, foreclosure forbearance, or a number of other strategies or sell your home before it goes into foreclosure. Whether it's genetic or stems from military training or listening to the Rolling Stones or 1940s jazz bands, scores of Boomers and Seniors are facing hearing loss. Those who live alone may not realize that their hearing isnt quite up to snuff. When talking to, do some Boomers and Seniors ask you to repeat what you say or give responses to questions that seem a bit off?

Hearing loss could be the culprit, and you could be the person who helps them by suggesting they get their hearing checked. Let them know they're not alone. A host of high-profile Boomers, including Bill Clinton, wear hearing aids. Some hearing devices are getting downright hip, such as the ones by a Swiss company that aims to remove the stigma associated with hearing aids. Foreclosures, Foreclsures, Foreclsoures......

Today’s news broadcasts are filled with reports that the number of home foreclosures is extremely high. Georgia, in fact, is now leading the Nation in home foreclosures and the trend seems bound to continue for a while. This situation has been brought about by an assortment of factors including a period of extremely lax credit requirements, faulty appraisals, and misunderstood adjustable rate mortgage programs, just to name a few. The result has been that many people have found themselves in newly purchased homes or adjusted mortgage rates that they simply can’t afford, and that translates into foreclosure.
 
When a foreclosure occurs the lending institution or mortgage company that made the loan ends up becoming the owner of the foreclosed property. Banks, mortgage companies and other lenders do not want to be in the real estate business, but they must dispose of the foreclosed properties in order to recover the money they advanced in the original loan. Generally, this is done by listing the property with an agent or Broker who has been certified to represent the lender.
 
The Fauscett Team has a full time Foreclosed Properties (REO) Department that is headed by Don Smith. Our REO (Real Estate Owned) Department currently represents Fannie Mae, the Veteran’s Administration, Ocwen Financial Services, Countrywide Home Loans and various local lenders in the management and marketing of their foreclosed properties. We have a number of foreclosed listings in a variety of price ranges and receive new assignments on a weekly basis.
 
If you are interested in shopping the foreclose market for a personal home or for a potential investment, there are many things you need to know and many misconceptions you need to be aware of. The following are just a few tid bits that might help you more fully understand the foreclosed home market.
 
DON’T EXPECT THE DEAL OF THE CENTURY
 
Everyone wants to find a great deal and occasionally foreclosed properties can be bought under market value.  The fact of the matter is that there are hundreds of full time investors out there who do nothing but watch for under market “deals” on real estate. Many times these investors are aware of distressed properties before that foreclosure even takes place. In a lot of cases the “great deals” never make it to listing. That is not to say that good deals can not be realized by the average person, but it requires a lot of dedication and research . It is also very important that you be prepared to act quickly when a desirable property is found. If you found it, a lot of other people have found it, as well. Having your ducks in a row includes being pre-approved for necessary financing and being knowledgeable about offer procedures and necessary documentation, Generally, it is highly recommended that you work closely with an experienced real estate professional who is well versed in the foreclosure market and who can help you move quickly when you make the decision to place an offer.
 
IF IT IS PRICED LOW THERE MAY BE A REASON
 
Lenders and foreclosure companies are not in the business of losing money. There is no motivation for the lender to sell a property significantly below market value simply because it is a foreclosure. There is also no requirement that the lender or foreclosure company sell the property for the amount owed at the time of the foreclosure. Actually, the outstanding balance on a defaulted loan plays a very small part in the ultimate pricing of the property. Every attempt will be made, by the lender, to market the property at or very near market value. So, if you find what appears to be a bargain basement price on a foreclosed property you may be well advised to look deeper to determine why the price is so attractive. Often the low price is evidence that there are costly repairs needed that the lender simply did not want to perform. Since most foreclosures are sold “as is” the expense of performing those repairs will be your responsibility.
 
Most lenders and foreclosure companies make provision for an inspection period on their properties. Some allow a specific period of time to inspect after an offer has been accepted and some require that all inspections be done prior to the offer being submitted. It is important that you know the inspection provisions stipulated on the particular property you have an interest in before submitting an offer.


 
 
YOU ARE DEALING WITH A CORPORATION…NOT AN INDIVIDUAL
 
In a normal real estate transaction the parties are generally an individual home owner who is the seller and an individual buyer who wants to buy and live in the house in question. The seller generally has a personal reason or need for selling the property. Sometimes the reason or need may be financial or it may be emotional but there is usually some motivation on the part of the seller. In working with foreclosed properties you will be dealing with a business. Usually the Asset Manager who has been assigned a property will have never seen the property except in photographs supplied by the listing agent. To that Asset Manager the house you so want to buy is nothing more than a file, there is no emotion involved. It is important to remember that these businesses deal with hundreds and thousands of properties. As such they have their own rules and procedures that have to be followed without variation. Simply put, if you don’t want to play by their rules you don’t play in their game. When entering into a transaction on a foreclosed property it is a good idea to ask the listing agent to provide you or your agent with the Purchase Addendum used by the seller. The terms of the Addendum should be carefully read and you should be sure that you understand and agree to those terms. Most lenders and foreclosure companies do not allow any alteration to or variance from the terms of their addendum. You will also note that there will usually be a clause in the addendum that states that if there is a conflict between the terms of the addendum and any other document related to the transaction, the terms of the addendum will prevail. In other words, you can write what ever you want into the Georgia contract, but if it is not supported by the seller’s addendum it will have no effect on the transaction.
 
MAKE REASONABLE OFFERS
 
As was said earlier, the lenders and foreclosure companies are not in the business to lose money. If you do have a serious interest in a particular property it is important that you make serious offers. Asset Managers for these lenders and foreclosure companies are very busy people who do not favor taking the time and effort to respond to and counteroffer extremely low offers. In some cases an extremely low offer will not receive any response at all. You, or your agent, should ask the listing agent whether or not this particular seller will extend counteroffers. Many lenders and foreclosure companies have a policy that prohibits them from making counteroffers…they either accept or reject. It is also important to bear in mind that an extremely low offer may have a negative effect on your ability to negotiate down the line if the Asset Manager starts out with doubts about your sincerity in the transaction.
 
 
DON’T SHOOT THE MESSENGER
 
Most lenders and foreclosure companies utilize the services of a local real estate agent or Broker to assist them in marketing their properties. That agent or Broker is trained in how to follow the rules, procedures and guidelines of the lender as the listing agent. The listing agent does not work for the lender, he or she does not set pricing on the properties; he or she does not make the rules or establish procedures (nor does he or she have the authority to change or alter the rules and procedures); and he or she has no influence in the acceptance or negotiation process. Even though the listing agent is a representative of the lender or the seller, you should be able to look to him or her for advice and assistance in placing an offer in the proper manner. Bear in mind that it is a primary goal of the listing agent to see that the property is sold and a commission is earned. On the other hand, if you are not happy with the requirements and procedures in the offer and purchase process, remember that the listing agent is merely a middleman representing the seller. Please don’t take your frustrations out on the listing agent.

Staging your Home

In this slow housing market it is important to do everything you can in order to sell your home. Two of the most important things you can do are pricing your home correctly and making sure your home shows well. Your realtor should help you with pricing your home, but making sure your home shows well is where staging comes in. Staging your home is something a lot of sellers are doing these days to give them an advantage over other homes in the market. Before you stage, take pictures of your house during the day, inside and out. What the camera sees and what you see are two different things. The pictures will help you see with an unbiased eye.

Attitude - The 7 Keys to Positive One by Nancy Friedman

Why do some people have such a great attitude and others a negative one?  Well, we wondered the same thing and through our research we found seven keys that those with a positive mental attitude all share.  How do you rate?
1) Choose Your Attitude in Advance: When you wake up, you have a choice.  You can be in a good mood or a bad mood.  You also choose your attitude.  You can wake up and mutter to yourself, “This is gonna be a cruddy day,” or you can tell yourself, “This is gonna be a great day!”  This choice is the start of a great attitude.
2) Visualize Success: Runners in the Boston Marathon picture themselves crossing the finish line.  Picture yourself having a successful day.  Self-visualization is a key factor in having a positive mental attitude.  Will it work 100% of the time?  I wish it would.  However, by visualizing your success, you’ll be able to have a better handle on what does happen, and having a better chance of making it happen.
3) Demonstrate Humor, Energy, and Enthusiasm: We call these three items the magic ingredients.  Without them, creating a positive mental attitude will be difficult.  There is normally humor in every situation.  Finding it is key.  Sometimes you’ll need to stretch and dig a little deeper to find the humor in a situation.  But once you do, you’ll feel so much better.  Energy is important because without some energy in your attitude, you’ll be dragging behind everyone.  Energy is closely related to the third ingredient, enthusiasm.  Enthusiasm is contagious; let’s start an epidemic!
4) Resist Negative Influences: It’s a fact.  When we have a negative experience with a company, we’ll tell more people about it than if we have a good experience with the same company.  Many times, when you hear that someplace wasn’t very good, you’ll believe the person who told you and choose not to do business with that company.  However, you may only be hearing half the story.  Check things out for yourself.  Especially if the negativity involves a person you work with or know.  We’ve all heard negative things about someone we didn’t know and then when we had the opportunity to meet them ourselves, we find that they’re not as bad as someone had alluded to.  In fact they might be nice, but you need to be the judge.  Take negativity out of your life.  Steer clear of those who drag you down and say negative things.  Being around other positive people is a good start.
5) Be a Whatever-it-Takes Person: This means, be a problem solver.  Life is going to put obstacles in front of all of us.  How we go around those obstacles is key.  There’s normally a good answer to every problem put in front of us.  Dale Carnegie said it best.  Ask yourself, “What is the worst thing that can happen here?”  Then move up from that.
6) Embrace Change; Expect it and Accept it: Some people are very good at handling change and some resist it.  The major key to handling change is to accept it; deal with it.  In most cases there’s little we can do to stop it anyway.
7) Be Grateful for What You Have: Many people have so much and yet those same people are often the ones that constantly complain.  Why wait for some life-altering experience to be grateful?  Be grateful, now. 
These are the seven keys to having a positive mental attitude.  Put them into practice and you will be amazed at the difference they can make.

Happy 4th of July!

The 4th of July is tomorrow and I get the day off (Yeah!) so I wanted to go ahead and submit a blog on behalf of The Fauscett Team wishing everyone a fun and safe Independence Day!

My family is a very patriotic family. I remember being a child and my mother, sister and I would sing patriotic songs just for the heck of it. I guess it was because they were songs we all knew and enjoyed singing. I am not saying we are good singers, but just that we loved to sing. There is another story there, but I am going to stick to the 4th of July theme today. Anyway, we celebrated our Independence Day this past weekend at our Sunday night Family night. My Mom read to us something I found very interesting and I thought I would share it with all of you. It is about the National Anthem. It actually has four stanzas instead of the just the one. I had no idea. She read the story about how it was written by Mr. Francis Scott Key and then read the whole thing to us. I have included a link to this information if you are interested. I was talking about this with Chris Phillips who also works in our office here part time helping me. He knew about the other stanzas. About is the key word here. He didn't know what they said or anything. This got us to talking about what other facts Americans don't know about our Independence or History that we should. Jay Leno recently did his Jaywalking skit where he asked people on the street questions about the history of our Independence. It was funny how much they didn’t know. I wanted to include a link to the video clip of this , but couldn't find one easily. Chris did find the questions that were asked. He also found a link to 20 questions taken from the naturalization test that people have to take to become American citizens. I thought this would be an interesting thing to send out for people to test what they know or don't know. I got a 70% which isn't too bad, but it should have been better. Chris said when he took it he got 100%. That is why he is going to Georgia Tech and I didn't. Well, check out this link just for fun. Naturalization Test

Maybe later this week, after the holiday, I will post the story about my families singing habits. I think it is funny, but then again it is my crazy family.

Happy Father's Day!

The Fauscett Team wants to wish all those fathers out there an early Happy Father's Day! I love my father and am thankful everyday that he has been in my life. I heard this morning on the radio that a good percentage of fathers who have to pay child support are more likely to skip a child support payment then a used car payment and that a large percentage of divorced fathers lose contact with their children within the first year. This is a sad and scary reality. It makes me realize how I take for granted that my father is in my life, how thankful I am to have him in my life, what a great influence he was growing up, and what an important part he played in making me who I am today. 

   Recently, I heard a country song titled "He Didn't  Have to Be" by Brad Paisley. This song made me cry (not that this is a hard thing to do). It is a child talking about a man who becomes his step father, how they become a family, and he hopes that he will one day become half the dad his step father didn't have to be. I bring this up because it is also important to recognize those men who stand up and become fathers. There is a quote I like "Any man can be a father, but it takes someone special to be a Dad."  So for those out there with a Dad, biological or not, take a step back and think about what it means to have him in your life and express this to him on Sunday. If you don't have a Dad then think of the male figures in your life and the ones that meant the most to you. On Sunday let them know how much you appreciate them.
